2. INFORMATION AND TERMINOLOGY

Our website https://gradisoft.com (hereinafter, the “Website”) uses a technology called “cookies” in order to collect information about the use of the Website, in accordance with the provisions of Article 22 of the Spanish Law on Information Society Services and Electronic Commerce (LSSI).

Cookies are small files that websites, online stores, intranets, online platforms or similar place on the browser of the user visiting them. They allow previously stored information to be retrieved and provide numerous advantages in the provision of interactive services, as well as relevant information to the owner of the Website.

3. TYPOLOGICAL CLASSIFICATION OF COOKIES

The following classification of the main types of cookies, provided by way of example as the most common, helps to better understand the functions they perform:

3.1. TYPES OF COOKIES ACCORDING TO THE ENTITY THAT MANAGES THEM

Depending on the entity that manages the device or domain from which the cookies are sent and processes the data obtained, the following can be distinguished:

a) First-party cookies

These are sent to the user’s terminal from a device or domain managed by the editor itself and from which the service requested by the user is provided.

b) Third-party cookies

These are sent to the user’s terminal from a device or domain that is not managed by the editor, but by another entity that processes the data obtained through the cookies.

Where cookies are served from a device or domain managed by the editor itself, but the information collected through them is managed by a third party for its own purposes (for example, to improve the services it provides or to provide advertising services to other entities), they shall not be considered first-party cookies.

3.2. TYPES OF COOKIES ACCORDING TO THEIR PURPOSE

There are many purposes for which cookies are used. Depending on the purpose for which the data obtained through cookies are processed, some of the main categories are:

a) Technical cookies

These allow the user to browse a website, platform or application and use the different options or services that exist on it. This includes cookies used by the editor to manage and operate the site and enable its functions and services, such as controlling traffic and data communication, identifying the session, accessing restricted areas, remembering the items that make up an order, carrying out the purchase process, managing payment, controlling fraud related to service security, managing registration or participation in an event, counting visits for the purposes of billing software licences used to operate the service (website, platform or application), using security elements during browsing, storing content for the broadcasting of videos or sound, enabling dynamic content (for example, animation of loading a text or image) or sharing content through social networks.

Also included in this category, due to their technical nature, are cookies that enable the management, in the most efficient way possible, of advertising spaces that the editor has included as an additional element of the design or layout of the service offered to the user, based on criteria such as the edited content, without collecting information from users for purposes other than those, such as personalising that advertising content or other content.

Technical cookies are exempt from the obligations set out in Article 22.2 of the LSSI where they are strictly necessary to provide the service expressly requested by the user, as in the cases described above. However, if these cookies are also used for non-exempt purposes (for example, behavioural advertising), they will be subject to those obligations.

b) Preference or personalisation cookies

These allow information to be remembered so that the user accesses the service with certain characteristics that may differentiate their experience from that of other users. For example: language, the number of results displayed when the user performs a search, the appearance or content of the service depending on the type of browser used to access it, or the region from which it is accessed, etc.

If the user is the one who chooses these characteristics (for example, by selecting the language of a website by clicking on the corresponding flag icon), such cookies will be exempt from the obligations under Article 22.2 of the LSSI, as they are considered a service expressly requested by the user, provided they are used exclusively for the selected purpose.

c) Analytics or measurement cookies

These allow the party responsible for them to monitor and analyse the behaviour of users of the websites to which they are linked, including quantifying ad impressions. The information collected by these types of cookies is used to measure activity on websites, applications or platforms, in order to introduce improvements based on the analysis of usage data made by users of the service.

With regard to the processing of data collected through analytics cookies, the former Article 29 Working Party (GT29) indicated that, although such cookies are not exempt from the obligation to obtain informed consent for their use, it is unlikely that they represent a risk to users’ privacy, provided that they are first-party cookies, process aggregated data for strictly statistical purposes, provide clear information on their uses and include mechanisms for users to express their refusal.

d) Behavioural advertising cookies

These store information on users’ behaviour obtained through the continuous observation of their browsing habits, which allows the development of a specific profile to display advertising based on it.

3.3. TYPES OF COOKIES ACCORDING TO THE LENGTH OF TIME THEY REMAIN ACTIVATED

Depending on the period of time they remain active in the terminal, the following can be distinguished:

a) Session cookies

These are designed to collect and store data while the user accesses a website. They are usually used to store information that is only needed to provide the service requested by the user on a single occasion (for example, a list of products purchased) and are deleted at the end of the session.

b) Persistent cookies

In these cookies, the data remain stored on the device and can be accessed and processed for a period defined by the party responsible for the cookie, which may range from a few minutes to several years.
